Terms of Use

By accessing or using the flipinsurance.com.au website (“Site”) or the Flip Insurance mobile app (“App”), you agree to accept and comply with these terms of use (“Terms of Use”). Throughout this document, “App” refers to the Flip Insurance mobile application available on various app stores. Flip Insurance Pty Ltd (“Flip” or “we”) reserves the right, at Flip's sole discretion, to amend these Terms of Use, this Site and our App, at any time without notice. Any subsequent access to, or use by you of, this Site or App will constitute an acceptance of these modifications.

This Site and App are operated by Flip and all information contained on this Site and App is owned or licensed by Flip.

The Flip Privacy Policy, which describes how we handle your personal information, forms part of these Terms of Use.

1. Use of this Site or App

Personal use only

Apart from any fair dealing for the purpose of private study, research, criticism or review, reporting news, parody or satire as permitted under the Copyright Act 1968 (Cth), you may only use the information on this Site or App for your own personal reference and reproduce such information for your personal use.

Software

If you download any software from the Site or App, the software (including any files and/or images incorporated in or generated by the software) and data accompanying the software (collectively, the "Software"), Flip grants a licence to you to use the Software. You must not sell, distribute, decompile, reverse engineer or otherwise deal with the Software in a like manner.

Prohibited use

Other than as set out above and unless we provide our prior written consent, you must not distribute or transmit information on this Site or App to any other person or incorporate such information, in any way, into another document or other material.

2. Use of our App 

Access to our App

Subject to these Terms, you may install one copy of the App onto your Device as set out in these Terms and use it in accordance with these terms for your own personal, non-commercial use. 

We may, from time to time, update or modify the features or functionality of the App to reflect developments in technology or to alter or add to existing functionality. Any available updates, enhancements and new versions of the App will become automatically available when you next access the App. 

You are responsible for making all arrangements necessary to access the App and maintaining the confidentiality of your login details. You must take all reasonable precautions to keep your password confidential, including not disclosing your password to anyone else.

You are also responsible for ensuring that all persons who access the App through your Device and internet connection are aware of these Terms, and that they comply with them.

Prohibited uses of App

You may only use the App in accordance with these Terms.  You must not use the App:

  • in any way that breaches any applicable law or regulation;
  • in any way that is unlawful or fraudulent or has any unlawful or fraudulent purpose or effect. This includes, for example, by hacking into or introducing viruses, trojans, worms, logic bombs or other material which is malicious or technologically harmful into the App;
  • for the purpose of harming or attempting to harm individuals in any way;
  • to transmit, or procure the sending of, any unsolicited or unauthorised advertising or promotional material or any other form of similar solicitation (including “spam”); 
  • to attempt to gain unauthorised access to, interfere with, damage or disrupt the App, any software used in the provision of the App or any server, computer or database connected to the App, including via a denial of service attack or a distributed denial of service attack;
  • in a way that could damage, disable, overburden, impair or compromise the App, or its systems or security, or in a way that could interfere with another user's rights, use or enjoyment of the App; 
  • to reproduce, duplicate, copy, sell, trade, or resell the App content (including its design and look) or any output derived from the App. You are not entitled to modify or redistribute the App content (including its design and look) or any output or to reproduce, store, link, frame or deep-link it on any other App or in any other medium or format without our prior written consent; or
  • for commercial exploitation in any circumstances.

2. Consent to electronic delivery of documents

Where Flip is required, by law or otherwise, to provide you with a document, you consent to the provision of that document electronically through the links on this Site or App. We suggest that you print a copy of the document or file it electronically for future reference. 3. Communication facilities, including social media channels

This section 3 governs your use and access to our social media channels and platforms (including Facebook, Instagram and X) and other communications facilities available on or through the Site or App (the “Communication Facilities”).

What we expect from you when using the Communication Facilities

When accessing and using the Communication Facilities, you must not:

  • post, communicate or transmit any unlawful, criminal, threatening, abusive, defamatory, libellous, contemptuous, obscene, vulgar, pornographic, profane, indecent or inappropriate material, including any material that would materially and adversely affect the reputation of Flip. Flip may decide at its sole discretion whether any material is "inappropriate";
  • post, communicate or transmit material which violates or infringes the rights of any other person or party or infringes any law; interfere with the computer systems which support the Communication Facilities, overload a service, engage in a denial-of-service attack, attempt to disable a host or inhibit or restrict any other user from using the Communication Facilities;
  • post, communicate or transmit any file which contains viruses, worms, “trojan horses” or any other harmful, contaminating or destructive features;
  • access or attempt to access information resources you are not authorised to use;
  • impersonate or falsely represent your association with any person or organisation or otherwise provide false or misleading information;
  • attempt to modify, adapt, translate, sell, reverse engineer, decompile or disassemble any portion of the Site or App, including the use of automated tools;
  • post, communicate or transmit or use any material of any kind for commercial purposes, or which contains any promotional material or advertising;
  • delete, circumvent or alter any author attribution, legal notices, rights management information or technological protection measures; or
  • post, download, communicate or transmit any file or material posted by another user if you know, or reasonably ought to know, that the file or material cannot legally be downloaded or communicated in that manner.

Our right to moderate the Communication Facilities

We welcome all your views, both positive and negative, but it will sometimes be necessary to moderate (review, approve or remove) content without your prior agreement on Flip's Communication Facilities. The decision to moderate content will be at Flip's absolute discretion but may be based on the factors, including, but not limited to, acting contrary to “What we expect from you when using the Communication Facilities” (set out above).

We may also block users from the Communication Facilities at our sole discretion, unless we are not otherwise allowed to (for example, if a social media channel does not allow us to do so).

4. Flip Insurance

You may purchase and manage Flip’s insurance products via our Site and App.

Flip’s advice is general in nature. We don’t take into account your personal circumstances.

When considering Flip’s insurance products, you should read and refer to our Product Disclosure Statement, Financial Services Guide and Target Market Determination before making any decision.

5. Flip Wellbeing

You may purchase and manage Flip’s Wellbeing products via our Site and App.

Flip’s Wellbeing products are not health insurance or any other form of insurance. Our Wellbeing products provide specific preventative care services, rather than cover for a medical condition or injury that may or may not occur.

The Flip Wellbeing products may include vouchers and/or subscriptions to access specific preventative services via our Site and App. 

The services available under each product are identified on the Site and App, and in any product specific Terms and Conditions. 

The services to be redeemed, using a Flip Wellbeing product, may be provided by a third party.

Flip does not offer refunds for unused vouchers/ subscriptions or access to services.

6. Links

One of the services that the Site or App provides is access to other sites or apps on the internet via hyperlinks located on the Site or App ("Linked Sites or Apps"). While Flip has used reasonable endeavours to review the Linked Sites or Apps, Flip is not responsible for the accuracy, legality, and decency of material or copyright compliance of the Linked Sites or Apps.

Links to the Linked Sites or Apps are provided for convenience only and do not represent any endorsement by Flip or any Flip Group Company of the products or services offered by the Site or App owner.

7. Disclaimer

This disclaimer is subject to any rights or remedies that you may have under law that cannot be excluded, restricted or modified by contract. This includes law contained in Schedule 2 of the Competition and Consumer Act 2010 (Cth) (Australian Consumer Law), the Australian Securities and Investments Commission Act 2001 (Cth) (ASIC Act), and the Corporations Act 2001 (Cth) (Corporations Act).

All information contained on this Site and App is given in good faith and has been derived from sources believed to be accurate and reliable at the time it was sourced. Flip will use reasonable efforts to update the Site or App regularly.

The materials in this Site and App are provided "as is" and without warranties either express or implied to the fullest extent permissible under law, including the Australian Consumer Law, ASIC Act and Corporations Act.

The information on the Site and App is only intended for use in Australia and for persons above the age of 18. The information is general in nature and should not be considered as a comprehensive statement on any matter.

Any advice contained on the Site and App is general advice only. The advice has been prepared without taking into account your objectives, financial situation or needs. Accordingly, before acting on this advice, you should consider whether the advice is appropriate, having regard to your objectives, financial situation and needs.

You should obtain the Combined Product Disclosure Statement, Policy, and Financial Services Guide relating to Flip Insurance and consider it before making any decision about whether to acquire the product.

To the extent permitted by law, neither Flip nor any of its directors, employees and contractors and agents guarantees the security of this Site or App to the extent that such a guarantee includes:

  • giving any warranty of reliability or accuracy of this Site and App and its content;
  • accepting any responsibility arising in any other way including by reason of negligence for, errors in, or omissions from, the information on this Site or App; or
  • accepting any liability for any loss or damage, however caused, as a result of any person relying on any information on the Site or App or being unable to access this Site or App.

8. Indemnity

You agree to indemnify Flip and keep Flip indemnified against all actions, claims, costs, demands, damages or liability arising in any manner from a breach by you of these Terms of Use.

9. Advertising

We may, through the Site or App (including push notifications if you have enabled them on your device settings):

  • advertise FLIP services, offers and promotions available to you. The terms that apply to such offers will be notified to you; and
  • include advertising by third parties, where the App contains third party advertising that links to websites and resources provided by third parties, these links are provided for your information only. We have no control over the contents of those websites or resources, and accept no responsibility for them, their content, or for any loss or damage that may arise from your use or consideration of them.

With your consent, we may also use your personal information to contact you from time to time (by email, phone, push notifications) to tell you about new products or services and special offers that we believe may be of interest to you (Direct Marketing). They may be offered by us, our related companies or our business partners. 

You can withdraw your consent (opt out) to receive Direct Marketing from us at any time by unsubscribing by clicking on the opt-out link in the marketing communication you receive or changing your profile settings in the App. You can also contact us to opt out using the contact details in the Flip Group Privacy Policy.  

The App may contain links to websites or other apps which we or our partners own, or websites or apps of our partners or third parties. If you follow any of these links, the websites, apps and services provided through them will have their own privacy policies and terms of use. We do not accept any responsibility or liability for these or their collection and use of any personal information as a result of your use of the App. Please review the relevant privacy policies and terms of use before providing any personal information, or using their websites, apps and services.

10. App terms 

Apple Terms

This clause only applies if you access the App through Apple's App Store ("App Store”).

You acknowledge and agree that:

  • this agreement is between you and Flip and not with Apple and that, as between Flip and Apple, Flip is responsible for the App and the content;
  • the licence granted to you under clause 2.1 to use the App is non-transferable license to use the App on any Apple-branded products that you own or control and as permitted by the Usage Rules set forth in the Apple Media Services Terms and Conditions, except that the App may be accessed and used by other accounts associated with the purchaser via ‘Family Sharing’ or volume purchasing;
  • Flip, and not Apple, is responsible for:
    a. providing any maintenance and support services with respect to the App;
    b. any express or implied warranties to the extent not effectively disclaimed. In the event of any failure of the App to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price for the App to you. To the maximum extent permitted by applicable law, Apple will have no other warranty obligation whatsoever with respect to the App, and any other claims, losses, liabilities, damages, costs or expenses attributable to any failure to conform to any warranty will be Flip’s sole responsibility;
    c. addressing any claims you or any third party relating to the App or your possession and/or use of the App, including, but not limited to:
        (i) product liability claims;
        (ii) any claim that the App fails to conform to any applicable legal or regulatory requirement; and
        (iii) claims arising under consumer protection, privacy, or similar legislation; and
    d. the investigation, defense, settlement and discharge of any such claim in the event of any third party claim that the App or your possession and use of the App infringes that third party's intellectual property rights;
  • you must comply with applicable third party terms of agreement when using the App; and
  • Apple and its subsidiaries are third-party beneficiaries of this agreement and Apple has the right (and will be deemed to have accepted the right).
  • You represent and warrant that:
    • You are not located in a country that is subject to a U.S. Government embargo, or that has been designated by the U.S. Government as a "terrorist supporting" country; and
    • you are not listed on any U.S. Government list of prohibited or restricted parties.

Google Play Store Terms

This clause only applies if you access the App through the Google Play Store.

You acknowledge that:

  • these Terms are between you and Flip only, and not with Google, Inc. (“Google”);
  • your use of the App must comply with Google’s then-current Google Play Store Terms of Service;
  • Google is only a provider of the Google Play Store where you obtained the App;
  • Flip, and not Google, is solely responsible for the App;
  • Google has no obligation or liability to you with respect to the App or these Terms; and
  • Google is a third-party beneficiary to these Terms as it relates to the App.

11. Governing law and jurisdiction

These Terms of Use are governed by the laws of New South Wales, Australia. The parties submit to the jurisdiction of the courts of New South Wales, Australia.
